TERMS OF SERVICE


General Terms

When describing your commission, please write in a clear and concise manner and provide clear references. Any ill-advised or rude behavior will not be tolerated. If any of the aforementioned behavior occurs, the commission will be canceled.

I reserve the right to deny/cancel any commission for any reason.

The commissioner must provide at least 1 reference picture/detailed description; Simple or unclear references will not be exempt from small change fees due to unclear communication.


Updates

After the artist has received the full payment for the commission, the commissioner will receive one rough sketch of the commission to review over. The commissioner will then have the opportunity to list any changes or adjustments that they require. Please be very clear and concise when listing changes - there is no second revision update.

When the commission is complete, only minor changes can be made without extra fees. What is determined as "minor" is at the artist's discretion.
Any major changes will result in an extra fee up to 20%-50% of the original determined price at the discretion of the artist.

Major changes can be, but are not limited to:

Change in character design

Change in character pose

Adding or subtracting objects/props/characters

Background changes

If the commissioner gave unclear references from the start, they will not be entitled to minor changes without a fee.


Time Frame

Commissions can take up to 3 months to be completed. Deciding factors can be, but are not limited to:

Complexity of commissionWorkload of commissionHealth issuesFamily issuesUnexpected or sudden emergenciesSchoolwork or Exams


Cancelling/Refunding Policy

The commissioner cannot demand refunds from the artist under any circumstances after the payments are received.

If the artist accepts the commission but a payment invoice has not been sent promptly, the commissioner has the right to cancel the commission.

If a charge-back is charged against the artist by the commissioner, the rights of the commission will be retracted from the commissioner and given to the artist.

The artist holds the right to file a complaint(s) if necessary.

If the artist determines that they are unable to finish the commission, they hold the right to cancel the commission and a refund will thus be issued to the commissioner.

Should the commission possibly take longer than the initial 2 months, the commissioner will be notified promptly.


Copyright and Usage Policy

Commissions are personal use for the commissioner only. Commercial use or redistribution of the art without the artist's consent will result in the commissioner's rights to the commission being terminated. The commissioner automatically allows the artist permission of use of the commission.

The artist retains the right to the artwork they produce and reserves the right to use the commissioned art for how they deem fit. (sales distribution/portfolio usage/self-promotion etc.)

If you have reasons that you would prefer that I do not use the commissioned art for commercial use, please inform me when writing out the details of said commission so that we can discuss the subject.

The tampering of the commission by anyone besides the artist is considered copyright infringement and thus will result in termination of commissioner rights to the commission.
This includes, but is not limited to:

Removing the watermark and/or signature

Changing aspects of the commission after it is completed

The commissioner is allowed to post or print the commissioned art for personal use only. If the commissioner posts the artwork, they must credit the artist. The artist will not misinterpret or misrepresent the original designs or the intent of the commissioner.
